MIAM (Mediation Information & Assessment Meeting)

At Family Solution Mediation, we provide MIAM appointments for individuals considering court proceedings. A MIAM is a confidential meeting where we explain how mediation works and assess whether it is suitable for your situation. This is usually required before applying to court for family-related matters. These meetings are held separately from your ex-partner to ensure that you have made your own decision to come to mediation and are not at any risk of any abuse. We ensure the process is clear, supportive, and handled with sensitivity. Should you decide the need to take the legal route, your attendance at a MIAM proves to the court that you have made an informed decision. If you or your ex-partner agree to try mediation, then an appointment is made for your first mediation session. If you do not wish to start mediation, or it is not suitable for your circumstances, the mediator will be able to discuss the other options open to you and sign the relevant court form to show that you have considered mediation. This means that you can take your case to court if this is what you choose.

Drafting of Documents

As part of the mediation process, we can prepare key documents that record discussions and agreements reached during mediation. These documents help provide clarity and can support you when seeking independent legal advice.

  • Parenting Plan- Parenting Plan sets out practical arrangements for children after separation. It may include where the children will live, time spent with each parent, holiday arrangements, communication, and how important decisions about the children will be made.

  • Statement of Outcome of Mediation -This document provides a brief summary of the agreements reached during mediation. It can be shared with solicitors or other professionals to help progress next steps.

  • Open Financial Summary- An Open Financial Summary outlines the financial information shared by both parties during mediation, such as income, property, savings, debts, and pensions. This document is open and can be shared with solicitors or the court if needed.

  • Memorandum of Understanding -A Memorandum of Understanding (MOU) summarises the proposals and agreements reached in mediation. While it is not legally binding, it can be taken to a solicitor who can turn the agreement into a legally binding document if required.
